What is an offence and what is a penalty?
An offence is a wrong has been committed against the people of South Africa as a whole, and it is prosecuted under the criminal law. A penalty is the punishment a person gets for committing an offence. The Act specifies a number of offences and penalties that may be incurred if the offences are successfully prosecuted.
